Spotted checking out vehicles in casino garage

CHARGE: Third-degree burglary
DETAILS: Osage Nation Officer William Wilmott on Nov. 8 received a call regarding a burglary in progress in the parking lot of the Tulsa Osage Casino. Officer Wilmott was notified that a window had possibly been broken on a vehicle in the casino parking garage. While he was en route to the casino, he talked by telephone with casino security officers, who said they were with the suspects, on the second floor of the parking garage. A casino security supervisor told Wilmott that the two suspects had been observed via video surveillance as one of them took something from the bed of a pickup truck on the third floor of the parking garage. The suspects were then reportedly observed as they drove down to the second floor of the garage and one of them made entry into a black GMC Yukon through a rear window that had previously been broken and taped up. When casino security approached the man who had entered the truck through the rear window, he was reportedly still inside the truck. Identified as Benny Brooksher, the suspect reportedly said the truck belonged to a woman who had given him permission to enter it and get $5. Casino security told Officer Wilmott that a second man, Ricky Shrum, acted as though he did not know Benny Brooksher and was just giving him a ride to the casino. Officer Wilmott noticed that both Brooksher and Shrum appeared to have bloodshot and glassy eyes, “pinpoint” pupils, slurred speech and lethargic movement. The owner of the black Yukon reportedly told Officer Wilmott that he did not know either Shrum or Brooksher and neither of them had permission to enter his truck. Casino security also reportedly discovered the two suspects had been filmed looking at vehicles on the first floor of the parking garage. In hearings Nov. 13 in Osage County District Court, the court entered not guilty pleas for the defendants in regard to the burglary case.
MISDEMEANOR CASES
Found a man lying on a bed
NAME: Charles Curtis Taylor
AGE: 36
RESIDENCE: Pawhuska
CHARGE: Breaking and entering without permission
DETAILS: Corporal Sam Soutter, of the Pawhuska Police Department, about 10 p.m. on Nov. 13 was dispatched in regard to a report of a residential break-in. Corporal Soutter and Sgt. Daniel Alden arrived at the call location. Sgt. Alden was informed that someone had entered the house at the back door on the northeast. With duty weapons in-hand, the officers checked the house for intruders. They reportedly found a man lying on a bed, on his stomach. Corporal Soutter ordered the man to show his hands. There was no response. Soutter again gave the order, and again there was no response. Soutter then used his right foot to push the feet of the male subject and get a reaction. The male subject on the bed reportedly sat up. Soutter checked the male for weapons and then recognized him as Charles Taylor. Soutter and Alden reportedly smelled an odor associated with intoxication on Taylor and noticed Taylor’s speech was slurred. Soutter asked Taylor if he lived at the house, and Taylor reportedly said, “What’s going on?” The officers then read Taylor his Miranda rights. They also talked to the homeowner, who reportedly said that she had let Taylor stay at the house a few times before and that he had come to the house earlier in the day, but he was drunk. The homeowner reportedly said she told Taylor that he is not allowed there if he has been drinking, and he left. The police officers moved Taylor outside and questioned him further. He reportedly told the officers that he had been staying at the house. In a hearing Nov. 15 in Osage County District Court, the case was set for a hearing Dec. 20.
Uses his ‘slapjack’ to ‘beat the f… out of people’
NAME: James Edward Lee III
AGE: 36
RESIDENCE: Tulsa
CHARGES: Carrying weapons; unlawful possession of drug paraphernalia; public intoxication and disturbing the peace
DETAILS: Deputy Martin Meek conducted a traffic stop about 9:33 p.m. Nov. 9 based on equipment violations. Deputy Meek reportedly observed a white Dodge Ram pickup to have a modified exhaust system and a defective brake light. James Lee III reportedly was a passenger in the vehicle. After a police dog reportedly gave a positive alert for the odor of narcotics, a probable cause search of the vehicle was conducted. During the search, Deputy Meek reportedly found a silver, keyed lock attached to a portion of a belt that was wrapped in black electrical tape. This item reportedly was in a pocket of a hoodie that Lee was wearing. Lee reportedly said the item was his “slapjack” that he uses to “beat the f… out of people.” The deputy also reportedly found a single used and capped syringe containing a crystal-like substance in a pocket of Lee’s pants, and a multi-colored, glass marijuana smoking device in the back seat behind Lee. When speaking with Lee, Deputy Meek reportedly smelled the odor of marijuana about him. The deputy also reportedly noticed Lee’s eyes were bloodshot and his speech was slurred. Meek asked Lee if he had recently smoked marijuana and the suspect reportedly said, “I just smoked a fat blunt before I ate.” In a hearing Nov. 14 in Osage County District Court, the court entered a not guilty plea for Lee.

NAME: Cody Chase Rasberry
AGE: 25
RESIDENCE: Broken Arrow
CHARGES: Possession of a controlled dangerous substance; unlawful possession of drug paraphernalia; and defective vehicle
DETAILS: Deputy Martin Meek conducted a traffic stop about 9:33 p.m. Nov. 9 based on equipment violations. Deputy Meek reportedly observed a white Dodge Ram pickup to have a modified exhaust system and a defective brake light. Cody Rasberry reportedly was the driver of the vehicle. After a police dog reportedly gave a positive alert for the odor of narcotics, a probable cause search of the vehicle was conducted. A blue, plastic container reportedly was located in Rasberry’s jacket pocket. Rasberry reportedly said the jacket belonged to his father. Deputy Meek reportedly observed a crystal-like substance and a cut straw inside the plastic container. The crystal-like substance reportedly field-tested positive as methamphetamine. Deputy Meek also reportedly found a broken clear glass smoking device, commonly used to ingest methamphetamine, in a zipper pouch attached to the driver’s side visor. A set of digital scales with a crystal-like residue was reportedly found underneath the driver’s seat. In a hearing Nov. 13 in Osage County District Court, the court entered a not guilty plea for Rasberry.
Pleaded no contest in drinking incident
NAME: Joseph Roger Lynn
AGE: 21
RESIDENCE: Pawhuska
CHARGE: Public intoxication and disturbing the peace
DETAILS: Officer Doug Castleberry, of the Pawhuska Police Department, was dispatched Nov. 11 to 2909 Lynn, in regard to a call about an individual being intoxicated at his mother’s home. When he arrived, Officer Castleberry spoke with the reporting party, who reportedly said, “My son is in the backyard crying. He’s been drinking and I just want him to go home.” The officer and the reporting party eventually located the subject of the call in his mother’s home. The officer reportedly noted that Joseph Lynn was unsteady on his feet, his speech was slurred and there was an odor of alcohol coming from his person. The officer learned that Joseph Lynn lived in a garage behind his mother’s residence. Shortly after Joseph Lynn returned to his home, Sgt. Daniel Alden of the Pawhuska Police Department arrived. Officer Castleberry noted in a case affidavit that while he was talking with Ms. Lynn, he heard “banging and screaming coming from inside Joseph’s residence.” A neighbor reportedly came outside due to the noise. “Joseph ran out of his residence towards Sgt. Alden and I as if he wanted to fight,” Officer Castleberry noted. “Sgt. Alden drew his conducted electrical weapon (CEW) due to Joseph’s aggressiveness. Joseph was ordered to stop, which he complied and began talking about his phone being stolen,” Officer Castleberry added. In a hearing Nov. 12, Joseph Lynn pleaded no contest, was found guilty and fined $100 and ordered to pay court costs.
Homeowner heard pounding and screaming
NAME: Hunter Jay Edward Burnett
AGE: 21
RESIDENCE: Barnsdall
CHARGES: Breaking and entering dwelling without permission; and public intoxication and disturbing the peace
DETAILS: Osage County Deputy Johnny Porter was dispatched about 8:37 p.m. Nov. 8 to 95 North 6th Street in the town of Osage in reference to a report of men fighting. When he arrived, Deputy Porter talked with Bobby Taylor, a homeowner, who said he heard someone “pounding on the outside of his residence and screaming.” Taylor reportedly said he walked outside and saw Hunter Burnett kicking the door to his garage and screaming. Taylor had his wife call 911. Deputy Porter reportedly asked Burnett what he was doing, and Burnett reportedly said he had been chasing his girlfriend and her new boyfriend through the woods for several hours. Burnett reportedly said he thought that he heard his girlfriend in the garage, that he kicked the door open to try to find her, but did not find her in the garage. Deputy Porter noticed heavy damage to the garage door frame, and that the door latch was on the ground. After observing Burnett’s physical condition, Deputy Porter reportedly asked Burnett when he had last used methamphetamine. Burnett reportedly said he used meth earlier in the day. In a hearing Nov. 12 in Osage County District Court, the court set Burnett’s bail at $1,000 and his next court date for Feb. 7, 2020.
Broke in the door
NAME: Amy Michelle Young
AGE: 36
RESIDENCE: Skiatook
CHARGE: Public intoxication and disturbing the peace
DETAILS: Officer Tyler Bates, of the Skiatook Police Department, was dispatched about 1:41 a.m. Nov. 5 to 4221 West Redeagle in reference to a report of a female with a knife assaulting a male. When Officer Bates arrived, he reportedly observed that Officer Mark Dressler had a female subject, later identified as Amy Young, detained outside a residence. Officer Bates also observed a man identified as Hugh Sexton outside the residence, holding an infant. Officer Bates recorded in a case affidavit that he talked to Hugh Sexton, who said he had told Amy Young he didn’t want her to stay at the house overnight, and said she was upset and made a threat involving a knife. Sexton reportedly said he locked the door and called the police. Sexton reportedly said Young kicked in the door, but no longer had the knife. Young assaulted him, Sexton reportedly told police. Officer Bates observed the door was broken and pieces of it were on the floor. He also reportedly observed that Young could not stay still, was talking fast and erratically and could not stop licking her lips — behaviors which the officer interpreted as symptoms of public intoxication. In a hearing Nov. 7, Young pleaded no contest. She was found guilty, fined $100 and ordered to pay court costs.
Domestic conflict in Fairfax
NAME: Lamoine Jean Wilkey
AGE: 24
RESIDENCE: Fairfax
CHARGE: Domestic abuse — assault and battery
DETAILS: Officer Alton Horne, of the Fairfax Police Department, responded to a report of a domestic altercation that occurred Nov. 3. He talked with a woman who had an eye that was swollen and red. The woman said Lamoine Wilkey, with whom she had been living for some three years, hit her three times in her left eye. When Officer Horne talked with Wilkey, his version of events was that his girlfriend hit him in the back and her face hit his knee while he was trying to get away. In a hearing Nov. 6 in Osage County District Court, the court entered a not guilty plea for Wilkey and set his bail at $4,000, conditioned on his having no contact with the alleged victim.
