Deputies document threats
NAME: Dale Lynn Jackson II
AGE: 40
RESIDENCE: Hominy
CHARGES: Domestic assault and battery in the presence of a minor; and threatening to perform an act of violence (three counts)
DETAILS: Shortly after 9 p.m. Sunday, April 14, Deputy Corby Sorrells responded to a 911 call regarding an assault. A woman complained that her boyfriend assaulted her at her home and accused her of “talking to her neighbor.” The boyfriend also reportedly said that the next time he saw the father of the woman’s children he would beat the man. The boyfriend, identified as Dale Lynn Jackson II, reportedly threw a pop bottle at the woman and then punched her in the face. These acts reportedly occurred in the presence of the woman’s children. Deputy Sorrells and Deputy Martin Meek met with the woman and asked for details of the assault. The woman provided the officers with a detailed account, which included Jackson allegedly throwing other punches in addition to the one at her face. The victim reportedly said this was not the first time Jackson had assaulted her. Deputy Sorrells and Deputy Meek reportedly made contact with Jackson by performing a traffic stop on his pickup, which Sorrells noted did not have working tag lights. Sorrells said in an affidavit that Jackson commented, “Next time I get pulled over by the cops, I’m gonna make y’all shoot me.” Jackson reportedly became irate and said in front of the deputies that he would assault his girlfriend and a man who lives next door to her. Deputy Sorrells read Jackson his Miranda rights and asked him if he wanted to talk. Jackson reportedly said he wanted to talk, and during the conversation that followed he reportedly threatened to knock out the neighbor’s teeth. Jackson denied having hit his girlfriend, reportedly saying he would have assaulted her but he slipped and fell. Jackson reportedly told Sorrells to take him to jail, and added that when he got out he would whip the neighbor’s behind. During his trip to the Osage County jail, Jackson also reportedly threatened to beat up Deputy Sorrells. In a hearing April 16 in Osage County District Court, Jackson pleaded not guilty. His next court date is set for May 17.

NAME: Stewart Joseph Quinton Cheshewalla

CHARGE: Domestic abuse — assault and battery
DETAILS: Deputy Robert Testerman said multiple assaults occurred from Friday, July 13, 2018, through Sunday, July 15, 2018. The victim told authorities she had been hit repeatedly with a steel bar. Cheshewalla also reportedly hit the victim multiple times with his hands. Cheshewalla reportedly assaulted the victim again with his hands on July 18, 2018. An arrest warrant was issued April 16, 2019, in Osage County District Court for Cheshewalla on a single count of domestic abuse — assault, according to a court record.

CHARGE: Domestic assault and battery against a pregnant woman
DETAILS: Deputy Corby Sorrells on Nov. 20, 2018, responded to a report of an assault in the Sand Springs area. A dispatcher told Sorrells that St. Francis Hospital in Tulsa said a woman who came there for treatment informed medical personnel that her boyfriend, later identified as Panchal, had assaulted her. The victim told Deputy Sorrells that she found messages and photos from other women on her boyfriend’s phone and waked him up and confronted him about it. Panchal reportedly began to assault her, including a kick to the stomach area, and she said that she began to scream. Her aunt and uncle responded and reportedly got Panchal to leave the house. The victim told authorities that she and Panchal had been having an ongoing intimate relationship and she was six weeks pregnant. The victim reportedly said Panchal was aware of the pregnancy. In a hearing April 23 in Osage County District Court, Panchal entered a not guilty plea. His next court date is listed as May 23.

DETAILS: Hominy police officer Michael Copeland on Oct. 22, 2018, had a conversation with representatives of the state Department of Human Services about providing assistance for a welfare check of the residence of Jason and Lora Frey and a minor child, based on information provided to DHS to the effect that marijuana was being grown at the residence. According to a case affidavit, DHS told the police that it had received information about Lora Frey using marijuana in the presence of the minor child, and regarding physical and verbal abuse and unlivable conditions. Officer Copeland and representatives of DHS reportedly went to the Frey residence and asked Lora Frey if marijuana was being grown there. “My husband has seeds,” Lora Frey reportedly said. A DHS representative asked for permission to do a walk-through and reportedly received permission. During the walk-through, Officer Copeland reportedly observed 37 seedling marijuana plants in a grow room. The officer asked Lora Frey if she or her husband had a medical marijuana card and she reportedly said her husband had one. Copeland reportedly told Lora Frey that neither she nor her husband were allowed to have that many marijuana plants. Officer Copeland said in a case affidavit that he stepped outside the residence at one point to make a phone call. A short time later, Lora Frey reportedly wanted to leave the home to go to the store and the officer told her that she could not go because of the investigation. The officer added that he needed to collect the marijuana seedling plants. Lora Frey reportedly replied, “I pulled them and flushed them, didn’t know I shouldn’t have, you told me I shouldn’t have them, so I panicked and flushed them.” Jason Frey reportedly told police he was trying to grow plants for personal use and that it was his fault he had 37 plants that he meant to reduce to the six plants allowed by law. During a hearing April 23 in Osage County District Court, the court entered a “general denial” of charges for Lora Frey. Jason Frey entered a not guilty plea, according to a court record.

NAME: Kevin Lee Hilton

DETAILS: Barnsdall police officer Rick Harper on March 10 was assigned to conduct an investigation regarding the theft of a 16-foot utility trailer at 309 Birch, Barnsdall. The victim reportedly said that Hilton had come to his home about 5 p.m. March 6 and asked to use his utility trailer. The trailer was reportedly valued at $1,600. Hilton reportedly agreed to return the trailer “within a couple of days.” Officer Harper said in a case affidavit that he contacted Hilton several times between March 14 and March 19 and Hilton said each time that he would return the trailer. Hilton reportedly said he had the trailer loaded with antiques and was unloading it and would return the trailer. The trailer was not returned as promised and the victim told Officer Harper that Hilton had called him and “cursed him for involving the police.” Officer Harper said in his affidavit that he gave Hilton opportunities to come to the police department and explain why he had not returned the trailer. Each time, Hilton either did not show up or refused to talk and hung up on Harper, the officer said. In a hearing April 18 in Osage County District Court, Hilton entered a not guilty plea. His next court date is listed as June 20.

NAME: Tyler Duane Chapman

CHARGES: Driving a motor vehicle while under the influence of drugs; driving while the privilege is revoked; failure to maintain insurance or security; failure to pay tax due to the state; and failure to wear a seat belt
DETAILS: State Trooper Romulus Gregory, about 7:10 a.m. on Dec. 9, 2018, was called to a collision scene for an investigation. When Trooper Gregory arrived at the scene he observed a maroon Buick with an expired license plate. Gregory determined the Buick ran off of Cherokee Boulevard and hit a large brick mailbox, destroying it. Gregory found Chapman asleep in the back of an Osage County deputy sheriff’s patrol truck and asked the suspect if he recalled how the collision occurred. “I was driving and I think I hit a mailbox. I’m not sure what happened after that,” Chapman reportedly told Gregory. The trooper noted that Chapman had bloodshot eyes with dilated pupils, that his speech was slurred and he appeared to have a dry mouth. Chapman appeared sluggish and continued to nod off, Gregory observed. The trooper asked Chapman when he last used any illegal drugs and the suspect reportedly said, “Over a year and a half ago, I’m on probation.” Gregory said Chapman was in obvious need of medical attention and asked to be checked by a doctor. Medics took charge of the suspect. The trooper did a records check and found that Chapman’s driver’s license was revoked. The trooper also checked the seat belt in the maroon Buick and made a determination it had not been in use, which was most likely the reason Chapman had a bloody nose after the accident. When Gregory arrived at Bailey Medical Center in Owasso to check on Chapman, the medical staff informed him that Chapman was trying to leave. Chapman reportedly had said, “I have to leave before the cops show up.” Gregory made contact with Chapman at the emergency room and explained to the suspect that he was displaying indicators of possible recent use of illegal drugs. Gregory asked Chapman again if he had consumed alcohol or illegal drugs. “I drank maybe a beer and smoked marijuana. I just took one hit,” Chapman reportedly said. Since Chapman was in a hospital bed and medical personnel were shortly going to do tests on him, the trooper did not offer field sobriety testing. Instead, he offered Chapman the state’s blood test. Chapman reportedly agreed to the blood test. An arrest warrant was issued April 16 in Osage County District Court for Chapman.

NAME: Wendy Yvonne Moore

DETAILS: Osage Nation police investigator Michael Kennedy on March 6, 2019, was assigned to investigate a case that involved Wendy Moore allegedly causing damage to the Osage Casino Tulsa’s parking garage by driving a box van that was too tall for the garage into the facility. Kennedy said in a case affidavit that several surveillance cameras and signs were destroyed, costing the casino thousands of dollars in damage. In a hearing April 25 in Osage County District Court, Moore entered a not guilty plea. Her next court date is listed as May 17.
MISDEMEANOR CASES
Witness said she was stealing clothing
NAME: Austen Chandler McCloud

CHARGES: Second-degree burglary; and larceny of merchandise from retailer
DETAILS: Hominy police officer Michael Copeland was dispatched to the Dollar General store at 103 East Main in response to a report of someone stealing clothes off a store rack outside the store building. Officer Copeland made contact with a witness, who reportedly saw a woman later identified as McCloud take clothing off the store rack, put it into the back of a vehicle and then get into the passenger side of the vehicle. The owner of the vehicle reportedly approached and told McCloud to get out of his vehicle. She reportedly did so, taking the clothing with her and throwing it into an entryway at the Osage Nation Head Start building. The witness helped Copeland make contact with the owner of the vehicle that McCloud reportedly entered. The vehicle owner said he observed a woman sitting in the passenger seat of his vehicle and opening the glove compartment and the center console and going through them. The vehicle owner said he took some phone chargers that belonged to him out of McCloud’s hands. An arrest warrant was issued for McCloud on Sept. 25, 2018, in Osage County District Court, according to a court record.

NAME: Rebecca Alene Betterton

CHARGE: Public intoxication
DETAILS: Deputy Casey Witt was notified about 11:44 p.m. Sept. 25, 2018, of a possible domestic incident in progress at 772 U.S. Highway 60. Deputy Witt was talking with Betterton’s mother when the suspect walked up and reportedly began yelling at them. Witt reportedly observed Betterton to be unsteady on her feet, to have bloodshot eyes and slurred speech. The deputy told to go inside, but Betterton reportedly did not comply. Betterton reportedly kept yelling at her mother, and walked over and “stood in her face.” Betterton pleaded guilty in a Sept. 26 hearing in Osage County District Court.
